Vino P&P<\/strong> The consumer, as a buyer, and Vino P&P as the seller, enter into a<\/p>\n\n\n\n Legal entities as buyers are subject to the application of the Obligations Act and the Electronic Commerce Act; the Consumer Protection Act does not apply to them. These General Terms and Conditions apply to legal entities regarding the main characteristics of the product, contract conclusion procedure, product price, payment method and shipping, product delivery description and costs, general information, warranty and service conditions, loyalty programs, disclaimer of liability, and the moment of contract conclusion. The seller, at its discretion, may grant a legal entity any consumer rights on a per-case basis.<\/p>\n\n\n\n A user is any person using the pervino.eu website, as well as any buyer and visitor to pervino.eu.<\/p>\n\n\n\n The conclusion of a sales contract via the pervino.eu website is regulated in accordance with legal provisions, especially the principles and directives of the European Union. Concluding a contract via the pervino.eu website is considered a distance contract.<\/p>\n\n\n\n These General Terms and Conditions also constitute a pre-contractual notice and apply to the conclusion of sales contracts if the buyer is a consumer, i.e. any natural person who enters into a legal transaction or acts on the market outside their trade, business, craft, or professional activity, and if the contract is concluded between a trader and a consumer within an organized sales or service provision system without simultaneous physical presence, using one or more means of distance communication up to and including the time the contract is concluded.<\/p>\n\n\n\n Means of distance communication include any means which can be used for distance contracting without the simultaneous physical presence of the trader and consumer, such as the internet and electronic mail.<\/p>\n\n\n\n The contract is concluded when the seller accepts the buyer\u2019s offer, and everything on the Vino P&P website constitutes an invitation to submit an offer. The seller can terminate the sales contract if the buyer does not pay the purchase price and is not obliged to deliver the product until receipt of payment, except when the buyer chose cash on delivery. If the buyer, for any reason, does not accept the shipment and it is returned to the seller, the seller will attempt delivery 2 more times; after a total of 3 unsuccessful delivery attempts, the seller will not attempt further deliveries.<\/p>\n\n\n\n A part of these General Terms and Conditions are also the General Terms for Personal Data Protection.<\/p>\n\n\n\n The content of the pervino.eu website is available in Croatian. The official language for concluding the sales contract is Croatian.<\/p>\n\n\n\n A service provision contract entered into on this website is valid until terminated by either party in accordance with applicable laws.<\/p>\n\n\n\n By accepting these Terms and Conditions and website Terms of Use, and accepting the offer, a service provision contract is concluded in both Croatian and English. If the user has any doubts or ambiguities, they are advised not to accept the contract or to consult a certified translator before accepting.<\/p>\n\n\n\n The buyer is informed of the main product characteristics on pervino.eu. Purchases take place on the Vino P&P pervino.eu website by filling out the appropriate form. While filling out the form, the buyer must enter all required data. The purchase may be completed only after the buyer confirms having read and understood the General Terms and Conditions and agrees to them, and acknowledges that the order implies a payment obligation. Purchasing is available 24\/7. Vino P&P is not responsible for any costs related to necessary computer equipment or telecommunications services.<\/p>\n\n\n\n The buyer will be informed by e-mail of the order confirmation (receipt of the buyer\u2019s offer) and shipment dispatch. If Vino P&P cannot deliver one of the ordered products for any reason, a Vino P&P employee will contact the buyer by phone or email to arrange delivery of a replacement product or possible cancellation.<\/p>\n\n\n\n Purchases made on behalf of or for the account of minors or persons lacking legal capacity (fully or partially) may only be made by their legal guardians.<\/p>\n\n\n\n Purchases are made by ordering available products selected by the buyer based on photo and description. Photos are illustrative and may not fully reflect the actual product. Shopping is performed in a few simple steps from the comfort of the buyer\u2019s home, from anywhere in the world.<\/p>\n\n\n\n Product search is possible by various criteria. Entering a term in the Search will list related products. The buyer can select and read about a product to determine if it suits their needs. Products are chosen from the pervino.eu catalog, sorted by type.<\/p>\n\n\n\n Product orders are placed electronically. Clicking \u201cAdd to cart\u201d adds the product to the cart. Adding to the cart does not reserve or purchase the product. The buyer may continue shopping, view the cart, or proceed to checkout. Checkout involves choosing the payment method, shipping method, entering a coupon or gift card, adding additional notes, e.g. for an R1 invoice. Purchase is not possible without checking the box \u201cI agree to the General Terms and Conditions,\u201d confirming that the buyer has read and agrees with these Terms, and checking \u201cI am aware that the order includes a payment obligation.\u201d By clicking \u201cChange cart contents,\u201d the buyer can modify the cart. The product will be shipped to the delivery service within 2-4 business days (excluding weekends and non-working days) after receipt of payment, except for cash on delivery.<\/p>\n\n\n\n If cash on delivery is chosen, the contract is concluded upon offer acceptance, and the product will be shipped to the delivery service within 2\u20134 business days (excluding weekends and non-working days) after contract conclusion.<\/p>\n\n\n\n Delivery is within Croatia within 2-4 business days (excluding weekends and holidays) of product handover to the delivery service.<\/p>\n\n\n\n The buyer must request an R1 invoice when ordering; retroactive requests will not be honored.<\/p>\n\n\n\n For bank transfer\/e-banking payments, the buyer must use the payment data received by email.<\/p>\n\n\n\n The agreed price is inclusive of all taxes and charges and expressed in euros.<\/p>\n\n\n\n For deliveries that do not meet the free shipping condition, delivery is charged depending on weight and destination. Vino P&P delivers within the European Union.<\/p>\n\n\n\n Buyers must accept and check shipments in the presence of the courier or seller at a Vino P&P location when arranged, to avoid subsequent claims for possible shipment damage.<\/p>\n\n\n\n If Vino P&P cannot deliver a product, the buyer will be notified and may cancel the order or wait for the product to become available. If Vino P&P cannot deliver within the agreed period, the buyer must grant a reasonable additional period for contract fulfillment.<\/p>\n\n\n\n If the buyer does not accept or refuses the product without valid reason, Vino P&P reserves the right to claim reimbursement of handling, transport, and any other possible costs.<\/p>\n\n\n\n The sale of alcohol to persons under 18 years of age is prohibited. The buyer must provide ID on request.<\/p>\n\n\n\n By entering the online store, the buyer confirms they are of legal age.<\/p>\n\n\n\n The buyer is obliged to check for any damage upon receipt and immediately report it to the courier or refuse delivery if visible damage is present.<\/p>\n\n\n\n pervino.eu will, upon a return or exchange request, refund the amount or replace the product within fourteen (14) days of receiving the returned product.<\/p>\n\n\n\n If a replacement is unavailable, only a refund is possible. Returns must be sent to: Vino P&P, Sveti Servul 7c, 52466 Novigrad. In case of a complaint (pursuant to NN19\/22 articles 60 & 84), the user bears the return shipping costs. The user must return products in the received condition and original packaging with shipment note and invoice.<\/p>\n\n\n\n The user\/buyer may unilaterally terminate the contract within 14 (fourteen) days without stating a reason. The user has no right to termination in the following cases:<\/p>\n\n\n\n To exercise the right to unilateral termination, the buyer must notify Vino P&P of the decision to terminate before the deadline by sending an unambiguous statement by mail (to Vino P&P, Sveti Servul 7c, 52466 Novigrad) or email (pervino.prodaja@gmail.com<\/a>), stating name, address, phone\/fax\/email, or by using the termination form.<\/p>\n\n\n\n The form for unilateral termination, available HERE, may be filled in and submitted electronically, in which case Vino P&P will promptly provide confirmation by email.<\/p>\n\n\n\n The deadline for unilateral termination is 14 (fourteen) days from receipt of the goods by the user or a third party designated by the user.<\/p>\n\n\n\n If the user terminates the contract, all payments, including delivery costs, will be refunded without delay and no later than 14 days from Vino P&P\u2019s receipt of notice, excluding costs of delivery above standard delivery. Refunds will be made using the same method as the original payment. If the user agrees to another method, no return cost is charged. Vino P&P may withhold the refund until the goods are returned.<\/p>\n\n\n\n The user must return goods without undue delay, at the latest 14 days from notice of termination. The user bears the direct return costs.<\/p>\n\n\n\n The user is, under Article 77(5) of the Consumer Protection Act, liable for any diminished value resulting from handling other than necessary to establish the nature, characteristics, and functioning of the goods. If the original packaging is damaged, the refund will be reduced accordingly; the user will be notified of any such reduction.<\/p>\n\n\n\n If at the user’s request, service provision began during the termination period, the user shall pay a proportionate amount for what has been provided up until notification of termination.<\/p>\n\n\n\n LINK TO THE TERMINATION FORM<\/strong> If the ordered but paid goods are not in stock (see \u201cDelivery\u201d), a refund will be given within two business days. The buyer may be contacted to confirm if they want to receive a partial shipment instead.<\/p>\n\n\n\n Pursuant to the Consumer Protection Act, the buyer is entitled to a complaint. The complaint is valid if it meets the requirements stipulated by the Obligations Act and the Consumer Protection Act. The buyer must return the product within the agreed period to the agreed address. The seller must, within 14 days of receiving a valid complaint, replace the product or refund the full amount.<\/p>\n\n\n\n All complaints are received by email as listed under Contact on this website. Any grievances should be sent in writing by post or email and will be addressed as soon as possible.<\/p>\n\n\n\n Please check goods upon receipt as subsequent claims may not be accepted.
